There are three things that come into play when you communicate. The way you talk. The way you listen to the other side. The way you communicate through your body language. Even in mediation, it is important that you are able to conduct yourself in a responsible manner in order to be able to accomplish all three.
While it may take every bone in your body not to come to blows, it is important to be sure that you remain calm and clearly state your case. If you start the “he did this/she did that” mentality, it is only going to lead to more costs and potentially a court case. Therefore, stick to the facts, speak clearly, and—although it will be hard—leave emotions at the door.
Also, it is just as important that you listen to the other side. While everyone wants to think they are right in every situation, every person has their own faults within a situation. Therefore, try hard to understand the other person’s point of view. It can aid in coming to an agreement and compromise everyone can live with at the end of the day.
In addition, try to leave gestures, eye rolling, heavy sighs, etc., at the door, as well. Whether you fully agree or not with a statement or a ruling, it is important to remain professional. The goal at the end is to come to a resolution—not to start more issues and pay more fees.
